ASSETS AT MARRIAGE IN RURAL ETHIOPIA AgEcon

This paper examines the determinants of assets at marriage in rural Ethiopia. We identify and test three separate processes that determine assets brought to marriage: assortative matching, compensating parental transfers at marriage, and strategic behavior by parents. We find ample evidence for the first, none for the second, and some evidence of the third for brides. We also find no evidence of competition for parental assets among siblings. Results suggest that parents do not transfer wealth to children in ways that compensate for marriage market outcomes. Certain parents, however, give more assets to daughters whenever doing so increases the chances of a daughter marrying a wealthy groom.

MELDING PRIVATE AND PUBLIC INTERESTS IN WATER RIGHTS MARKETS AgEcon

The debate over privatizing and water markets has moved back and forth for decades between the "I" and the "We" perspectives. Rather than either/or, a balanced "I&We" view of water institutions is needed. West is meeting east in water law. Public interest needs must be satisfied in appropriate decision forums, but marketing may prove a social improvement when used as a supplement. Balancing an "I&We" institution involves establishing an acceptable or tolerable level of interference through judicious mixing of state, common and private property regimes. Third-party effects are eliminated as mutual gain arises in a variety of decision forums.

The Capacity of Property Rights to Accommodate Social-Ecological Resilience Ecology and Society

Here, I consider how social-ecological resilience can be facilitated by the use of property rights. Taking a legal perspective on the use of different forms of property, I consider how property rules can manifest the attributes of flexibility, responsiveness, optionality, and scalability associated with resilient systems. I note how different regulatory regimes such as domestic law and international law have differing capacities to accommodate property rights, and this in turn affects the capability of property to sustain resilience. The fluid nature of resilience and property systems defies simple conclusions about the influence of property rights on resilience. This essay outlines an alternative “law and economics” interpretation of the concept of the land market. According to neo-institutional researchers, institutions provide the framework and the rules in a society, including legal regulations. This study is based on the legal background in Hungary, and it analyses the current agricultural legal norms of land property. The voracious appetites of public versus private property: a view of intellectual property and biodiversity from legal pluralism AgEcon

In an opening vignette to an otherwise insightful article, Carol M. Rose (2003) compares people who hold intellectual property rights to poor villagers in India. They put effort and time into developing small but productive properties, only to have the wild tiger or rogue elephant of the public domain trample them or eat them up. In extreme cases, IP "villages" are abandoned and left to "the jungle" of public property. But Rose neglects another part of the story, and that is that the villagers are also hungry, and while they do not directly consume tigers, they do consume the environment a tiger needs to survive.
